Building in Fort Jeudy
By covenant, any building or extensive renovations within the Development must first be approved by the Association prior to the start of any such construction. It may be in the Lot owner's best interest to ensure such approval is in place prior to submitting the plans to the Physical Planning Unit for final approval. Any plans submitted to the Association for approval should include a completed copy of the Building Approval Application Form.
Approval of any building or renovation work is subject to, and will be guided by, the existing covenants on the use of the land within the Development. These covenants are by no means standard. There is a typical set but there are also many variations to it. The covenants were written by the original developers (no longer in existence) at the time of the division of the land. No one at this time, other than the holders of the deed has a record of what these variations are.
A cursory look around Fort Jeudy will reveal that the spirit of the covenants appears to be breached in a number of places. Lot Owners, as is their right, have made it clear that this is unacceptable and that the covenants must be enforced.
That being said it is recognized by all that certain variations may be necessary, as in some instances, the “standard” covenants are less than perfect in some respects. Variations have therefore been allowed to take into account such things as steeply sloping sites (slopes of more than 1 in 5), very small plots and corner locations. These variations will be continued and will be dealt with on their individual merits.
